Sublet agreement: a free template, plus the landlord’s consent letter

Before you sign

This is a general template, not legal advice. Under section 22(b) of the Rental and Loan Law, a landlord’s consent to sublet an apartment must be given in advance and in writing, so the second letter is signed before move-in. The template doesn’t replace the original lease: if that lease restricts subletting or sets conditions, its terms apply. It’s worth having a lawyer read it, especially for long stays or large sums. The documents

Sublet agreement

  1. Parties: __________, ID __________ (the main tenant), and __________, ID __________ (the subtenant).
  2. The apartment: the apartment at __________, which the main tenant rents from the landlord, __________. The landlord approved this sublet in advance and in writing, and the approval is attached to this agreement.
  3. Term: from __________ until __________. At the end of the term the subtenant will vacate the apartment and return the keys to the main tenant.
  4. Rent: ₪__________ per month, paid to the main tenant on the dates the parties agreed. A signed receipt will be given for every payment.
  5. Deposit: ₪__________, handed over at the key handover and returned at the end of the term, less any damage to the apartment or unpaid debt.

  7. Contents: the subtenant receives the apartment with the following items and will return them in the condition received, apart from reasonable wear: __________
  8. Use: the apartment is for residential use only. The subtenant will look after the apartment, keep the building rules and the terms of the original lease that concern its use, and will not hand it to anyone else.
  9. The main tenant remains responsible to the landlord under the original lease.
  10. Ending early: either party may end this agreement before the end of the term with __________ days’ written notice, unless the parties agreed otherwise in writing.
  11. Any change to this agreement must be in writing and signed by both parties.
